1. PRIVACY POLICY
  1. The application “BrainBeams” (“the Application”) is owned and operated by BrainBeams Health s.r.o., Company ID: 19422865, registered in the Commercial Register maintained by the Municipal Court in Prague under file number C 386333, with its registered office at Varnsdorfská 337/5, Střížkov, 190 00 Prague 9 (“BrainBeams”).

  2. Use of the Application and its content and information is subject to the acceptance and compliance with this Privacy Policy.

  3. We reserve the right to amend this policy. Any changes become effective on the date of their publication.

2. COLLECTION OF PERSONAL DATA
  1. We may collect your personal data in various ways. The information we may collect through the Application depends on the content and features you use and includes:

  • Personal Data: We collect and store any personal data related to your application profile that you voluntarily provide during registration or continued use:

    • User name (Nickname)

    • Email address

    • Demographic location (age category)

    • Gender

    • Time zone

  • Sensitive Data: For user safety, during registration, users must confirm they do not suffer from photosensitive conditions (e.g., epilepsy).
     

  • Derived Data and Uploaded Media: We automatically collect data from our servers when you use the Application—such as actions inherent to the Application, actions related to record creation, modification, and media uploads. For this, we may also request access to your device's photo library or camera to upload media to the Application. All such media will be collected and stored on our servers. You can manage these permissions in your device settings.

  • Access to Mobile Device: We may request access or permissions for certain features on your device, including reminders and other tools. You may modify this in your device settings.

  • Device Data: Includes information such as mobile device ID, model and manufacturer, OS version, phone number, country, location, and other data you choose to provide.

  • Push Notifications: We may request to send notifications regarding your account or the Application. You can disable such notifications in your device settings.

 

3. LEGAL BASIS, PURPOSE, AND DURATION OF PERSONAL DATA PROCESSING

   1. We process personal data based on and within the scope of legal obligations, contractual relationships, your consent, protection of vital interests, tasks carried out in the public interest, or our legitimate interests.

   2. We may process personal data for the following purposes:​

       a) Creating a personal profile for a more tailored future experience

       b) Monitoring and analyzing use and trends to improve your experience

       c) Motifying you about Application updates

       d) Requesting feedback and contacting you about your usage

       e) Improving our website and services

       f) Sending promotional and marketing emails about new products, special offers, or other information via your email address

       g) Scientific, research, development, and creative activities (especially in AI), in collaboration with scientific and educational institutions

   3. All personal data is processed electronically in an automated manner, stored in anonymized or pseudonymized form in multiple databases to ensure security.

4. HANDLING PERSONAL DATA
  1. We do not sell, distribute, or rent your personal data to third parties unaffiliated with us unless we have your permission or are required by law.

  2. In justified cases, your data may be processed by processors—external service providers who are contractually bound to maintain confidentiality, based on a data processing agreement (e.g., IT system providers, research institutions, universities, etc.).

  3. We may also use your personal data to send promotional information about third parties we believe may be of interest to you, if you opt in.

  4. We may also disclose your data:

  • To comply with any court order, law, or legal process, including government requests

  • To enforce or apply our terms of use and other agreements, including for billing and collection purposes

  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of the Application, our users, or others—such as in suspected threats to life or health or if a crime has occurred
     

 

5. TRACKING TECHNOLOGIES
  1. Cookies and Web Beacons: With your explicit consent, we may use cookies, web beacons, tracking pixels, and similar technologies to customize and enhance your experience. Detailed information is available in our Cookies Policy published within the Application, which forms part of this Privacy Policy.
     

  2. Website Analytics: We partner with third-party providers such as Google Analytics and Facebook Business Manager to track usage, determine content popularity, and better understand user activity through cookies. We provide information to third parties based on your consent. Please review their policies and contact them directly if needed.

6. THIRD-PARTY TOOLS
  1. The Application may contain links to third-party websites and applications, including advertisements and external services. Once you leave the Application, this policy no longer applies. Please read the privacy policies of those sites and take appropriate measures to protect your data. We are not responsible for third-party content or their privacy practices.

 
7. SECURITY OF YOUR INFORMATION
  1. We use administrative, technical, and physical security measures to protect your personal data.

  2. We are not liable for unauthorized third-party access or its consequences.

 
8. SPECIAL PROVISIONS FOR USERS UNDER 15 YEARS OF AGE
  1. The Application is not intended for children under 15. No one under 15 may provide any personal data via the Application. We do not knowingly collect data from children under 15. If you are under 15, do not use or provide any data, make purchases, use any interactive or public features, or share any personal information (e.g., name, address, email, nickname, or username).

  2. If we learn that we have collected or received data from a child under 15 without parental consent, we will delete it.

9. SPECIAL PROVISIONS FOR SENSITIVE PERSONAL DATA
  1. We designed the Application to minimize the handling of your personal data, yet we do require certain sensitive data—particularly health-related information.

  2. If you do not provide this information, the app will assume that health restrictions apply, and some features may be unavailable to you.

10. YOUR INFORMATION CHOICES
  1. You can view and edit your personal data by logging into your profile via the website or Application.

  2. To request access, correction, or deletion of any data you’ve provided, email us at: info@brainbeams.health.

  3. We may be unable to delete your data without also deleting your user account.

  4. We cannot comply with a request to change information if we believe it would violate any law or legal requirement or result in incorrect data.

  5. Upon request, we will deactivate or delete your account and data from our active databases.

  6. However, we may retain some data for fraud prevention, legal compliance, or troubleshooting purposes.

  7. Following a deletion request, any non-critical data will be retained for a maximum of 30 days, during which it will be fully removed from all databases and backups.

  8. You have the right to request access to, rectification, or deletion of your personal data, restrict or object to its processing, and the right to data portability.

  9. You also have the right to withdraw your consent at any time and file a complaint with the Data Protection Authority.

  10. These rights are governed by applicable data protection laws and the General Data Protection Regulation (GDPR).

11. INTERNATIONAL DATA TRANSFERS
  1. If you use our services from the European Economic Area (“EEA”), please note that you are providing information (including personal data) to the United States, where our partner platform servers are located. Our partners or employees outside the EEA may process this information. This data may then be transferred to and from the U.S. or other countries outside your country of residence, depending on the type and method of storage.

  2. These countries (including the U.S.) may not have data protection laws as comprehensive or protective as those in your jurisdiction.
